SMS Messaging Program

North West United Soccer Academy (NWUSA) operates an SMS messaging program to communicate with registered families. By providing your phone number to NWUSA, you consent to receive text messages from us.

What Messages We Send

Messages sent through our SMS program may include:

  • Payment reminders and fee due notices
  • Practice schedule updates and cancellations
  • Game schedules and location changes
  • Club announcements and event information

Message Frequency

Message frequency varies depending on club activity, season schedule, and upcoming events. You may receive up to several messages per week during active seasons.

Rates

Message and data rates may apply. NWUSA does not charge for text messages, but your mobile carrier may charge standard messaging and data rates.

How to Opt Out

To stop receiving SMS messages from NWUSA, reply STOP to any message. You will receive a one-time confirmation that you have been unsubscribed. To re-enroll, reply START or contact us directly.

Assumption of Risk

Participation in soccer and physical activities involves inherent risks, including but not limited to physical injury. By enrolling a player in NWUSA programs, the parent or guardian acknowledges and accepts these inherent risks on behalf of themselves and their player. NWUSA is not liable for injuries that occur during practices, games, or events that are inherent to the sport or result from the player's own actions.

Limitation of Liability

To the fullest extent permitted by law, NWUSA, its directors, officers, staff, coaches, and volunteers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your participation in our programs or use of our website. In no event shall NWUSA's total liability to you exceed the amount of registration fees you paid for the current season.

Disclaimer of Warranties

This website and all information provided by NWUSA are offered "as is" without warranty of any kind, express or implied. NWUSA makes no guarantees regarding the accuracy, completeness, or timeliness of any information on this site, including but not limited to practice schedules, event dates, and locations, which are subject to change without notice.

Force Majeure

NWUSA is not liable for cancellations, postponements, or changes to practices, games, or events caused by circumstances beyond our control, including but not limited to severe weather, facility closures, public health emergencies, natural disasters, or actions of government authorities. No refunds will be issued solely on the basis of events cancelled due to force majeure.

Photo & Media Release

By enrolling a player in NWUSA programs, the parent or guardian grants NWUSA permission to photograph and/or record their player during practices, games, and events. These images and recordings may be used for promotional, educational, and nonprofit purposes, including on our website, social media, and printed materials. No names of minors will be published without additional consent. To opt out, contact us in writing.

Indemnification

You agree to indemnify, defend, and hold harmless NWUSA and its directors, officers, staff, coaches, and volunteers from and against any claims, damages, losses, or expenses (including reasonable legal fees) arising out of or related to your violation of these Terms, your misuse of our website or SMS program, or your player's conduct during NWUSA activities.

Refund Policy

Registration fees are generally non-refundable once the season has begun. Refund requests made before the first practice of the season will be considered on a case-by-case basis. NWUSA reserves the right to deny refunds for any reason. Contact us at (971) 378-3935 to discuss your situation.

Code of Conduct

All players, parents, and guardians are expected to behave respectfully toward coaches, staff, officials, and other families. NWUSA reserves the right to suspend or remove any player or family member from the program for conduct that is harmful, threatening, or disruptive, without refund.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.

Eligibility

You must be 18 years of age or older to enroll in our SMS program. By providing your phone number, you confirm that you are 18 or older, or the parent or legal guardian of the player being registered.

Carrier Disclaimer

Carriers are not liable for delayed or undelivered messages. Message delivery depends on your mobile carrier and network conditions.

Privacy

Your phone number and personal information will not be sold or shared with third parties for marketing purposes. Mobile opt-in data and consent will not be shared with any third party under any circumstances. For full details, see our Privacy Policy at nwusafc.com/privacy.

Governing Law

These Terms are governed by the laws of the State of Oregon, without regard to its conflict of law provisions.

Changes to These Terms

NWUSA reserves the right to update these Terms at any time. Continued use of our SMS program after changes are posted constitutes acceptance of the updated Terms.
